On 24 May 2021, HHJ Dight CBE handed down a judgment in HPUT Trustee No.1 Ltd v Boots UK Ltd following the trial of an unopposed claim for a new tenancy. When calculating the s.34 rent, he decided it should not be assumed that the hypothetical tenant’s rental bid is to be depressed because of a fiction it has yet to move in to and fit out the property.
