Court of Appeal decision in Crossco No.4 UnLtd v Jolan Ltd

The Court of Appeal has handed down its decision in CrossCo No.4 UnLtd v Jolan Ltd [2011] EWCA Civ 1619. This important decision considers the nature of the common intention constructive trust and what is known as the ‘Pallant v Morgan equity.’  Romie Tager QC and Justin Kitson acted for the successful respondents to the appeal.
