Nicholas has a vibrant practice in Chambers’ core areas of commercial chancery litigation in both the High Court (Queen’s Bench and Chancery Divisions), County Court and First-Tier Tribunal. He is comfortable in a multiplicity of forums, from litigation to arbitration and mediation.

Commercial litigation: Nicholas is particularly interested in commercial dispute resolution, and draws on several years of experience of practice in commercial litigation and arbitration in Singapore and Malaysia. He has substantial trial experience, and his recent work includes:

  • Ongoing instructions as sole counsel in a US$1 million fraud claim.
  • Ongoing instructions as sole counsel on behalf of multiple defendants in a £700,000 High Court claim by a large online casino for misuse of confidential information.
  • Instructed as sole counsel in an unfair prejudice petition listed for an 8 day trial; Nicholas attended a settlement conference shortly before trial, where a successful settlement was reached.

Property: Nicholas’ practice covers a wide range of property disputes, from beneficial ownership disputes, to boundaries, easements, adverse possession and trespass. He was recently instructed in a 3 day TOLATA case, which settled in the courtroom.

Landlord and Tenant: Nicholas has appeared in many trials in commercial and residential disputes, including disrepair and dilapidations, possession, service charge disputes and forfeiture. He represented a charity seeking relief from forfeiture and a claim for conversion, when a forfeiting landlord seized all the charities property.

Insolvency: Nicholas is instructed in an array of insolvency matters, for individuals and corporations, and has advised insolvency practitioners. He was sole counsel in an appeal to the High Court on the effect of an arbitration agreement on a bankruptcy petition where the debtor has an arbitrable counterclaim, but otherwise no substantive defence to the debt.

Alternative Dispute Resolution: Nicholas has built up considerable experience of arbitration and mediation. He is a special contributor to Sandra Rajoo’s book on Law, Practice and Procedure of Arbitration (2016). Whilst in Singapore and Malaysia he has assisted in domestic and international arbitrations under a variety of institutions. He has advised on the enforcement of arbitral awards in England & Wales.

Nicholas has also appeared as counsel in a number of successful mediations.

He also sits as a chairman of the Valuation Tribunal for England & Wales hearing appeals on Non-Domestic Rates and council tax decisions.

He is proficient in written and spoken Thai.

Nicholas is a member of the Chartered Institute of Arbitrators and the International Bar Association.
